I'd say that a "drop shipping scam" is probably not the same as "drop shipping" and that should be the distinction here.

Yes, it's a scam. I just had the nerve-wracking experience to prove it. After reading the original post I quickly ordered a Mersk Train around 8pm (figuring after the Walmart frenzy I literally had minutes before OOS). It wasn't until the next day that I saw all of the updates exposing the scam. Well my package arrived today and literally 2 hours after delivery 2 local police detectives arrived at my door!! The person whose credit card was stolen had reported the LEGO purchase (made through TRU) to the police who tracked it back to me as the recipient. I walked them through everything I did --showed them the site where you can still purchase these, my confirmation email and PayPal records. Still made me nervous having 2 detectives questioning me as a suspect before I showed them I hadn't done anything wrong on my end.
I am amazed this site is still up with such an obvious credit card scam going on!

Wow, what a nightmare. If it weren't for this site and other LEGO forums, you wouldn't of have proven your point!

Yes, I realized I left out the "thanks" from my post...so thanks to everyone who helped point out the scam.
For a minute it seemed odd when I was talking with the detectives that I was well aware of the scam... I had to explain everything I had read on the forum.

Wow! Sorry that you had to go through that.

Most likely the site is run in another country that's just out of reach of our local or even federal jurisdiction to prosecute. I think at that point it's up to TLG to take action... somehow...

EDIT: Just checked out the site and did a whois lookup on the domain name. Shouldn't have shot my mouth off, it's registered to an address in Chico, California! Weird.

Just noticed the Lego Maresk Train is on sale and dropped to $107.98 at the Lego store (10% off).
